DUI Penalties For CDL Holders

Even if you are driving a noncommercial vehicle, if your blood alcohol content (BAC) is over the legal limit (.04% for CDL holders, compared to .08% for regular motorists), your CDL will automatically be suspended for 90 days. However, if convicted of DUI/OVI, it can result in a one-year CDL disqualification. A second DUI/OVI while driving a noncommercial vehicle, it could mean a lifetime CDL disqualification.

Additional charges may be filed if the DUI occurred in a commercial vehicle and the chemical test was over the limit or there was a chemical test refusal. First time DUI offenders can be punished with a maximum six-month jail sentence and a fine of up to $1,000.
