Avoiding Mistakes After a DUI Arrest

After a DUI arrest, you may be worried about what might happen next, or you could be thinking the situation couldn’t possibly get any worse. However, the case can get worse, depending on your circumstances.

Just After Arrest

Directly after your arrest, you will be brought to the police station and asked to take a blood or breath test. This test is designed to detect your blood alcohol content (BAC). You cannot refuse to take this test without incurring punishments, and the police can force you to give a sample anyway. Give the blood, breath, or urine sample when asked; otherwise, a refusal will be later used against you. Likewise, make sure you understand the full impact of the situation in which you find yourself. If this is your first DUI, you are likely to get off with a lighter sentence; however, many DUI offenders face severe punishments. Be prepared for what might happen after your arrest.

Days After Arrest

Make sure to avoid drinking alcohol while your DUI case is pending. Likewise, hire a skilled DUI attorney to represent you in court. He or she can work on mounting a defense and help you file a hearing with the Bureau of Motor Vehicles (BMV). When you receive court dates, make sure you attend these meetings with the judge. Not doing so can reflect poorly on you and might result in a harsher sentence.

Weeks After Arrest

If you are sentenced in your hearing, avoid getting another DUI and adhere to all stipulations they give you regarding your punishment. For example, if you are assigned community service, make sure to fulfill that requirement. Likewise, if you drive when your license has been suspended, you could face high fines and even jail time. If you don’t adhere to your punishment, you could suffer more severe consequences later.
